Abstract

Pre-Exposure Prophylaxis (PrEP) adalah sejenis ubat yang digunakan untuk mereka yang berisiko menerima jangkitan virus ‘Human Immunodeficiency Virus’ (HIV), yang dikenali sebagai penyakit ‘Sindrom Kurang Daya Tahan Melawan Penyakit’ (AIDS). Melalui ujian klinikal yang telah dijalankan, penggunaan PrEP telah terbukti dapat mengurangkan risiko jangkitan HIV/ AIDS. Pada penghujung tahun 2022, Menteri Kesihatan pada waktu itu telah mengumumkan akan menjalankan satu projek rintis penggunaan ubat PrEP di beberapa hospital kerajaan untuk menguji keberkesanannya sebelum ubat tersebut diperakukan oleh Kementerian Kesihatan untuk kegunaan awam.  Kenyataan tersebut telah mencetuskan kontroversi di kalangan ulama, ahli akademik, ahli politik dan juga masyarakat kerana dirasakan akan memberi manfaat kepada golongan homoseksual, biseksual dan transgender (LGBT) dan akan menyebabkan berleluasanya maksiat dan membawa kepada mafsadah yang lebih besar. Tidak dapat dinafikan bahawa PrEP dapat mencegah penyakit berjangkit, namun begitu, sekiranya ubat ini diberikan kepada golongan LGBT, dikhuatiri akan menyebabkan golongan ini semakin berleluasa sekali gus mendatangkan mafsadah yang lebih besar. Oleh itu, artikel ini akan menganalisis isu pemberian ubat PrEP kepada golongan LGBT dari perspektif Shariah. Untuk mencapai objektif ini, kajian ini menggunakan pendekatan analisis deskriptif dan induktif. Kajian ini menyimpulkan bahawa hukum pemberian ubat PrEP kepada golongan LGBT perlu diperhalusi mengikut kategori. Bagi kategori pertama; mereka yang terlibat secara aktif di dalam industri seks sebagai pekerja seks, pemberian ubat PrEP adalah haram dan mempunyai larangan yang jelas di dalam syarak. Manakala, bagi kategori  kedua; golongan LGBT yang tidak terlibat dalam industri seks, pemberian ubat PrEP  hendaklah diteliti dan dilakukan kajian lanjutan dan mendalam oleh pihak yang berautoriti dengan mengambilkira mafsadah yang lebih ringan dan menolak mafsadah yang lebih berat. Kerajaan juga haruslah memainkan peranan yang lebih serius dalam menangani golongan LGBT di Malaysia.

Pre-Exposure Prophylaxis (PrEP) is a drug used for those at risk of ‘Human Immunodeficiency Virus’ (HIV) infection, known as ‘Acquired Immuno Deficiency Syndrome’ (AIDS). Through the clinical trials that have been carried out, the use of PrEP has been shown to reduce the risk of HIV/AIDS infection. At the end of 2022, the Minister of Health announced that a pilot project on the use of PrEP drugs in several government hospitals will be held to test their effectiveness before the drug is certified by the Ministry of Health for public use. The statement sparked controversy among scholars, academicians, politicians, and the community as it is expected to cause more harm by benefiting the community of lesbian, gay, bisexual, and transgender (LGBT) that causes the spread of AIDS. It is proven that PrEP can prevent infectious diseases; however, if this drug is given to LGBT people, it is feared that they will feel safe to continue doing immoral acts, thus resulting in greater mafsadah. Therefore, this article will analyse the administration of this drug to LGBT people from the perspective of Shariah. To achieve this objective, the study used descriptive and inductive analysis approaches. This study concluded that the administration of PrEP to LGBT people needs to be refined according to categories and circumstances. For the first category, giving PrEp to those who are actively involved in the sex industry as sex workers is haram and has a clear prohibition in syarak. For the second category, the giving of PrEP to LGBT people who are not involved in the sex industry should be scrutinised and further in-depth studies carried out by the authorities taking into account the greater harm in society. However, the government should play an important role in dealing with LGBT people in Malaysia.
